General Terms and Conditions

1 Subject Matter of the Contract, Contractual Partner

1.1 These General Terms and Conditions (“GTC”) govern the sale of tickets for tours of the Infopoint-Jewish-Vienna by the Jewish Community Vienna, 1010 Vienna, Seitenstettengasse 4 (hereinafter also referred to as "we" or "IKG Vienna") to our customers (hereinafter also referred to as "you") via our website https://www.ikg-wien.at/infopoint  and by e-mail (infopoint@ikg-wien.at ; v.zirelman@ikg-wien.at ; incoming.infopoint@ikg-wien.at ; busi-ness@jewishinfopoint.at ; office@jewishinfopoint.at ).

1.2 Should any provisions of these GTC be invalid or void or become invalid or void in the course of their duration, this shall not affect the legal validity and force of the remaining provisions.

2 Booking process and contract execution (ticket bookings)

2.1 All offers at InfoPoint Jewish Vienna of the IKG Vienna shall be exclusively subject to these General Terms and Conditions. All amendments, supplements or ancillary agreements concerning these General Terms and Conditions, offers and services, as well as the waiver of the written form requirement, must only be made in writing. All ticket offers are subject to change and are only valid while supply last.

2.2 In order to book tickets for the offered tours via the booking system, the customer clicks on the link on our website, which directs him to the booking system. In the booking system, the customer is guided through the booking steps and selection options (e.g. number of tickets, date). By clicking on the button "Order with obligation to pay", the customer makes a binding offer to conclude a purchase contract with us.

Contract acceptance is effected by sending the ticket and the booking confirmation by e-mail and by making the ticket available on the website as a pdf file after the booking has been made. Therewith the sales contract between us and the customer comes into effect. If a tour is already fully booked, we will inform the customer by e-mail and refund the amount already paid.  

2.3 If the customer does not order tickets via the booking system but orders by e-mail to infopoint@ikg-wien.at; v.zirelman@ikg-wien.at; incoming.infopoint@ikg-wien.at; business@jewishinfopoint.at; office@jewishinfopoint.at, the customer makes a binding offer to conclude a purchase contract with us with his order. The acceptance takes place by sending the ticket by e-mail to the customer, whereby the purchase contract between us and the customer is concluded.

2.4 If we offer discounts, the information required for the discount must be provided correctly. There is no right to receive a discount. The customer must present an official photo ID at the time of admission or at the start of a guided tour to prove his entitlement to the discount and be ready to have his identity verified. 

2.5 The Customer agrees that the IKG Vienna may send invoices by e-mail.

3          Prices and terms of payment

3.1 The prices displayed in the booking system and by e-mail are in euros and include all taxes.  

3.2 Payment is made online via the payment methods offered and completes the online booking process. 

3.3 In the case of purchase transactions by e-mail, payment shall be made to the specified bank account of the IKG Vienna within 14 days of receipt of the invoice. 

3.4 If the Customer is in default of payment, IKG Vienna shall charge the statutory default interest from the date on which the invoice is due. If the IKG Vienna reminds the customer of the payment, reminder fees will be charged. The amount of the reminder charges shall be governed by the “Ordinance on the High Rates of Remuneration Due to Collection Institutions” (www.ris.bka.at). 

4          No Right of Withdrawal (Right to cancel)

4.1 The IKG Vienna offers online tickets to cultural events (guided tours) for a specific date and for a specific time (slot). This is a leisure event with a predetermined duration of time. Therefore, there is no right of withdrawal from the booking contract, according to § 18 Abs 1 Z 10” Fern- und Auswärtsgeschäfte Gesetz”. 

5          Validity of the Ticket and  Customer Lateliness

5.1 The ticket is only valid for the date and time for which it was issued. Late arrival and redemption is not possible. 

5.2 If the customer arrives late, the IKG Vienna reserves the right to shorten the event by the duration of the delay at an unchanged ticket price. If the customer does not appear after 15 minutes, the IKG Vienna reserves the right to cancel the tour if there are no other participants. In this case, the ticket price will not be refunded.

5.2 The ticket must be presented in printed form or digitally (on a mobile device) before the start of the guided tour. If the customer cannot present the ticket, he cannot participate. The customer is responsible for presenting a legible copy of his ticket. Illegible tickets will not be accepted.

5.3 The customer has no right to use the ticket more than once or to duplicate and misuse it in any other way.

5.4 If a Customer has unjustifiably claimed a discount when purchasing the ticket and is unable to present the requirements for the discount, his ticket will be invalidated. The ticket price will not be refunded. The customer will have the opportunity to pay the difference for the correct ticket price on the spot in order to keep the validity of the ticket.

6          Cancellation of a tour

6.1 We reserve the right to cancel guided tours. In case of cancellation by us, the price will be refunded to the customer and the ticket for the cancelled date will become invalid. The cancellation notice will be sent by e-mail.

6.2 The refund will be made through the payment method chosen by the customer at the time of booking.

7          Security check 

7.1 Prior to the start of the guided tour and admission, a security check of the participants will be carried out by the IKG Vienna. The Customer shall provide proof of identity, among other things, on site. 

7.2 If the Customer does not behave in accordance with the security measures on site, the Customer will be expelled from the event. The price will not be refunded. 

8          Warranty and Liability

8.1 The warranty is governed by the statutory provisions.

8.2 The Customer shall be responsible for providing an error-free and functioning e-mail address. The IKG Vienna shall not be liable if damage occurs due to an incorrectly provided e-mail address.

8.3 IKG Vienna shall not be liable if the service offered cannot be provided in accordance with the contract due to force majeure or unforeseen and unavoidable events. 

9          Final provisions

9.1 Any contract concluded with us shall be governed by Austrian law to the exclusion of the conflict of law rules of private international law.

9.2 The contract language is German or English. The German version shall be decisive.

(10) If the customer is an entrepreneur, the following shall also apply: 

10.1 The IKG Vienna shall be liable for damage caused by the IKG Vienna or its vicarious agents intentionally or by gross negligence. Liability for damage caused by negligence is excluded. This shall not apply to liability for personal injury.

10.2 The prices stated are gross prices. The statutory interest on arrears shall apply.

10.3 Any contract concluded with us shall be governed exclusively by Austrian law to the exclusion of the UN Convention on Contracts for the International Sale of Goods and the conflict of laws rules.

10.4 The place of jurisdiction for entrepreneurs (B2B) is Vienna.
